Under the Immigration Act, employers are prohibited from employing illegal foreign nationals.

In accordance with the provisions of the Immigration Act, all foreigners who wish to work in South Africa must have the necessary documentation to do so. This includes a work permit, which is issued by the Department of Home Affairs. Employers are required to verify that their employees have the necessary documentation to work in South Africa.
If an employer hires a foreigner who does not have a work permit, residents could face penalties, including fines or even imprisonment. In addition, the foreigner could be deported.
 
The Bendor Village Homeowners Association, as a body that oversees the management of properties in Bendor Village, has the responsibility to ensure that residents comply with the Immigration Act of South Africa. This includes laws regarding the employment of foreigners. As such, the Bendor Village Homeowners Association has the right to remind residents of their legal obligations and to take action if those obligations are not met, hence Bendor Village HOA will not register any foreigner who does not have a valid work permit or Zimbabwe Exemption Permit. Residents are responsible for ensuring that the foreigner's documentation is in order before employing a foreigner. This documentation must also be submitted when submitting the passport.
